A BILL
To amend the Klamath River Basin Fishery Resources Restoration Act to provide
for tribal representation on the Klamath Fishery Management Council, to clarify
allocation of the annual tribal catch, and for other purposes.
Be it enacted by the Senate and House of Representatives of the United
States of America in Congress assembled,
SECTION 1. KLAMATH RIVER BASIN FISHERY RESOURCES RESTORATION ACT.
(a) FINDINGS- Section 1 of the Klamath River Basin Fishery Resources
Restoration Act (16 U.S.C. 460ss), is amended--
(1) in paragraph (8), by striking `and' at the end;
(2) in paragraph (9), by striking the period and inserting `; and'; and
(3) by adding at the end the following new paragraph:
`(10) the Karuk Indian Tribe's fishery on the Klamath River is a federally
recognized and federally protected Indian fishery subject to such laws and
regulations as are otherwise applicable to Indian tribal fisheries on the
Klamath River.'.
(b) COUNCIL MEMBERSHIP- Section 3(c) of the Act (16 U.S.C. 460ss-2(c)), is
amended--
(1) in the first sentence by striking `11' and inserting `12'; and
(2) by adding at the end the following new paragraph:
`(6) A representative of the Karuk Indian Tribe who shall be appointed by
the governing body of the tribe.'.
(c) CLARIFICATION OF ALLOCATION- The Act (16 U.S.C. 460ss) is further amended
by adding at the end the following new section:
`SEC. 9. ALLOCATION OF ANNUAL CATCH.
`The Karuk Tribe's annual catch yielded through the tribal fishery on the
Klamath River shall be part of the tribe's in-river tribal allocation.'.
