Old Business

1.  Adjudication

Bill Ganong updated the board on the status of the Klamath River Adjudication process.  The hearings officer has denied a request from the Klamath Tribes for an extension to prepare for their Claim hearing.  The Adjudication Committee continues to work toward contest settlements.  

  1. Lawsuits/legal
    1. Takings

Ganong reported that Judge Allegra, the Judge assigned to the Takings Suit, has split the suit into 27 different cases and then consolidated them into one for the hearing.  Allegra has denied a request from Marzulla to reconsider the status of PCFFA as intervener in the Takings suit.  

    1. PCFFA II

Solem reported that the Yurok Tribe has filed an appeal to the PCFFA II decision in the 9th Circuit Court.  Briefs will be filed this year and oral arguments may be heard in 2006.  

    1. Straits Drain

The Klamath Water Users Association has appointed Solem as their representative at the July, 2005 settlement conference on the Klamath Straits Drain suit.  

  1. A-Canal Fish Screen

No action.  

  1. Grant applications
    1. 2025, BacGen, Intralox

Solem reported that the District’s Water 2025 grant application to the Department of Interior was not accepted, due to no commitment letter from BacGen.  Solem is trying to speak to someone to clarify BacGen’s roll in the Miller Hill pump station replacement project.  

BacGen has denied the District’s grant application for the Miller Hill project.  Their evaluation has determined that due to the efficiency of the existing pumps, an upgrade would not result in enough increased efficiency.  

Solem continues to look into a product called Intralox as a possible fish screen installation at Miller Hill.  

    1. 2006 Water 2025; others

Solem is beginning to work on the Water 2025 grant application for 2006.  

  1. Power
    1. Rate shock bill

Oregon State Senator Doug Whitsett has introduced SB 1058 to gradually increase the irrigators power rate increase by 50% the first year.  

Steve Kandra announced that a PUC hearing is scheduled for May 19, 2005 in Salem , Oregon to discuss Basin irrigator’s contracts.  The United States has filed for intervener status in the FERC/PUC process.

New Business  

  1. Equipment sale

1998 Ford F150 pickup – winning bidder was Francisco Venegas with a bid of $2285.

1998 Ford F150 pickup – winning bidder was John Cozby with a bid of $2852.

1998 Ford F150 pickup – winning bidder was Arturo Villa Ortega with a bid of $1600.

1976 GMC dump truck and 1968 Freightliner – winning bidder was Harvey Spears with a $100 bid for each.  

  1. 2005 Klamath Project operations

Solem reported that due to heavy rainfall, very little water is being delivered.  Only enough to keep the system charged is being drawn from the lake – approximately 210 cfs.  

    1. Link River Dam

Dave Sabo, BOR Klamath manager has received the requested information from PacifiCorp regarding agreements pertaining to operations of Link River Dam.  PacifiCorp’s position is that they have limited liability for the dikes.  Sabo will review the information and contact Solem for further discussion.  

    1. Rental Water

Solem reported that approximately 138 acres of contract water has been sold for 2005.  Approximately 31 acres were purchased by private users and the balance is made up of parks, cemeteries, and schools.  

    1. Water bank operation/evaluation

In their water bank evaluation, the USGS has determined that in the Klamath Basin , land idling is not effective, due to recirculation.  They also determined well water supplementation is limited due to ground water recharge.  

    1. Irrigation guidelines

The board had discussed sending out another irrigators update detailing irrigation guidelines due to the drought.  Since the inflows into Upper Klamath Lake and the lack of deliveries this past month, the board decided to forego the expense of a District wide mailing.  

  1. Executive Session:  Union negotiations

 

4.  Maintenance

           a.  repeater  

Solem asked the board to reconsider acquiring a separate repeater frequency for the automated telemetry throughout the District.  It is becoming very difficult for both field communications and telemetry to share the same frequency.  The board agreed and asked Solem to proceed with acquiring an additional frequency,  

           b.  pipeline areas  

The BOR will supply KID with approximately $87,000 in pipe for installation in the suburban area.  

Solem reported that portions of the covered pipeline in the suburban area are being seeded, to control erosion and weeds.  

  1. Public contracting training

a.      Future bids:  backhoe, copy machine  

Solem will send out bids for a backhoe on May 16, 2005 , for review at the June 9th Board meeting.  The bid will contain a request for bids with and without a trade.  

He will also prepare a bid for an office copy machine.  And the fax machine is about on it’s last legs.  

b.      Purchasing agent, sole source  

Solem updated the Board on a Public Contracting work shop he attended.  Changes to Oregon Public Contracting Laws may require minor changes to KID’s contracting procedures.  

Ed Bair made a motion to acquire the herbicide Magnacide H from a sole source provider (Baker Chemical) and the motion was passed unanimously.  

Motion was made and seconded to appoint Dave Solem, Cindy Cherry, and Mark Stuntebeck to act as purchasing agents for KID.  The motion passed unanimously.  

c.       Bands  

The Board authorized Solem to try different pipe bands in an effort to find a band suitable for KID applications.  

  1. Pending issues

a.      Agency Ranch/Barnes  

Solem and Greg Addington, Executive Director of KWUA will make comments requested by BOR as to who should control operations of the Agency and Barnes Ranches.  The board discussed various concerns with the U.S. Fish and Wildlife controlling operations.  

b.      Cell Tech removal and road access

 

Cell Tech is continuing to clean up their former installation on the B and C Canals.  KID has not received a written request and fee proposal for continued use of the west bank of the C Canal for access to their buildings.  

c.       Lost River TMDL  

No action.  

  1. Insurance

No action.  

  1. Exclusion/alteration agreement

The board approved an Alteration agreement with the Noonan’s to install a private concrete turnout sump on the east bank of the C Canal.  

  1. Partitions

Solem will investigate a partition request submitted to Klamath County by Ken Darrow for land on Reeder Road .  

  1. Other

Solem reported that KID is trying to comply with underground locate laws.  All excavating more than 12 inches deep will be called in for a locate.
