Attorney
Bill Ganong updated the Board on the Adjudication.
The Project Joint
Prosecution
group has stipulated that Modoc Point Irrigation District can move their
point
of
diversion without jeopardizing their claim if Chiloquin Dam is removed
and a new
pumping
plant is constructed in the
Williamson
River
.

Lawsuits/legal
a.
Takings
Ganong
updated the Board on the Takings Suit.
No oral argument has been scheduled
and
the Judge will likely rule on the written motions in the next few
months.

Power/KWUA/PUD/power
committee
Manager
Dave Solem gave an update of power rate issues.
He reported that Dennis
Daugherty
and Tom McCreedy of Riverside Inc. toured the C-Drop and other potential
power
generation sites and will report back to the District on the potential
of the sites.

b. PP&L
Bill
Solem
also reported that bills have been received from PP&L with
adjustments for a BPA rate credit given since 2005.
Solem has requested a written explanation of PP&l’s
interpretation of the credit. The
board (after an executive session) directed Solem to pay the PP&L
bills, but not to pay the adjusted charges until a written explanation
for BPA credit is received.
4. Hill claim
Solem
reported that Special Districts has settled an insurance claim submitted
by Billy Hill for fire damage to a fence and tree for $5724.00

New Business
1.
Water
Delivery Issues
a.
C-6 lateral users
6:30
pm
Irrigators
on the C-6 lateral including Richard Martinez, Fred Shulmire, Ralph
Cummings, Earl Collins, and Dave Beeson appeared before the Board to
express their dissatisfaction with water deliveries.
The C-6 downstream from Highway 39 is a private pipeline which
serves a 75 hp pump owned by Dan Chin and the other users.
Because of the size and condition of the private system and the
75 hp pump, irrigation is regularly interrupted.
The C-6 users also felt Chin was not ordering water and that KID
wasn’t doing anything to require him to work with the other users.
The Board recommended that the group look into improvements to
the delivery system in order to irrigate several users at once.
Solem told the group that he would talk with Chin and try to
improve the rotation so everyone can irrigate.
b. Shutoff date
The
Board discussed and approved October 13th as the shutoff date
for the A-Canal.
2.
Exclusions
a. Pheasant Run
subdivision; issues
The
Board considered a request for exclusion for the Pleasant Run
subdivision. Located
next
to the A-Canal immediately west of
Homedale Road
.
In a motion by Ed Bair and
seconded
by Jason Chapman, the Board unanimously approved the exclusion.
Solem
also
discussed an easement issue for the A-2 ½ on the west side of the
subdivision and
will
report back to the Board with his findings.
Currently the right-of-way does not extend
the
entire length of the lateral to the 1-c-3-b drain, south of
Bristol
Avenue
.
The
Board approved three additional exclusions.
b. Kiger area
subdivision
Solem
also reported on a proposed subdivision on a parcel next to the A-Canal,
north of
Kiger
Stadium – 14 homes on 28 acres. Developer
John Johnson has requested the
District
provide materials to construct a drain tile parallel with the A-Canal to
intercept any A-Canal seepage. The
Board declined the request.
3. Inclusion
Anna Cornacchioli appeared before the Board to request a Board Resolution
required by the Bureau of Reclamation to continue with an inclusion
process for Class C property owned by Cornacchioli.
Ross Fleming made a motion to approve the inclusion and to adopt the
following Resolution. The
motion was seconded by Jason Chapman and passed unanimously.
Whereas,
landowner Anna Cornacchioli has requested an Inclusion
Of 87.53 acres located in NW ¼ Section 1, Township 40 S. Range

E.W.M.,
into the Klamath Irrigation District,
Whereas, the Bureau of Reclamation has requested a Klamath Irrigation
District
Board resolution to proceed with their inclusion process,
Therefore It Is Resolved: The
Board of Directors approves of and requests
the
Bureau of Reclamation to proceed with inclusion of the described land.
4.
Ellen
Crawford request
The
Board reviewed a letter dated
August
4, 2006
from attorney Justin Throne representing Ellen
Crawford of Malin. Crawford
proposed to dedicate property she owns to the District if the District
is willing to pay survey costs and other fees.
A portion of the D-21 lateral is located on the property but has
no easement. The Board
directed Solem to see if the property could be transferred without a
survey and to report back to the Board.
5.
Maintenance
Solem
reported on several fall maintenance projects.
a.
A
Canal head gates
The
gate operations at the A-Canal has bearing problems requiring part
replacement. Both KID and
the BOR have ordered parts. KID’s
costs are approximately $1200. The
Board discussed concerns about getting the gates shut fully on October
13th.
b.
Mower
tire
Solem
reported a mower tire had to be replaced at a cost of $750.
c.
A
Canal box culvert undercrossing at KOA
The
Board approved a letter to be sent to
Klamath
County
and the Enterprise Irrigation District concerning a box culvert under
the A-Canal at the KOA campground. The
letter states that the maintenance of the culvert is the County Drainage
District’s responsibility.
d.
Adams
pumping plant
The
pump at the
Adams
pumping plant needs to be pulled. The
pump puller hoist has been working for the past 45 years but is starting
to show it’s age.
e.
Stutzer,
A-7-a
Solem
is still working with Lila Stutzer to negotiate a right-of-way on a
portion of the A-7 lateral across the front of her property in exchange
for a new pipe crossing to replace the one that is failing and causing
flooding.
6.
Employees
Solem
reported Jim Bowman has returned to work.
Jeff Williamson is still off.
7. Bids: bridge
limbers, pipe, postage machine
Solem
reported that bids will go out for bridge timbers, pipe, and a postage
machine.
8.
KWUA/NAS
The
National Academy of Science will meet October 3 and 4, 2006 in Yreka to
begin peer review of the Hardy II Flow Report and the Bureau’s
Naturalized Flow Study.
9.
Election
The
District has advertised the Notice of Election for the Board of
Directors for the position held by Ross Fleming.
10.
BOR
reserve works; ability to pay study
Solem
reported that the Bureau has completed an Ability-to-Pay study for KID
and has determined the District has $0/ac ability to pay.
Solem is hoping to meet soon with the new area manager Pablo
Arryava to discuss Project debt and A-Canal fish screen O&M issues.
The
Board also discussed the BOR’s proposal to transfer reserved works to
the districts for O&M.
11.
Budget
The
Board discussed the 2007 Annual Budget and likely budget issues.
Solem will prepare a draft budget for the October 19th
meeting.
