The

Pomona Grange
recommends that the
Siskiyou County
Board of Supervisors
not sign the two
agreements
associated with Dam
removal, for the
following reasons;
Our County
Supervisors(BOS) are
being pressured to
sign the Klamath
Basin Restoration
Agreement(KBRA) and
the Klamath Hydro
Settlement
Agreement,(KHSA)
which give away our
water, property
rights, and the
rights to elect
someone to
administer those
rights.
Even though the BOS have never been allowed to directly participate in the negotiation of the language in the KBRA and KHSA! This give away will happen by the parties to the agreements signing on February 11, 2010. The BOS has 60 days from then to decide.
How do we lose control of our water and property rights?
It is by carefully crafted language in the KBRA. Its called coordination.
The KBRA provides for two governing bodies to have complete control of ALL water in the Klamath River, all of the Tributaries that flow in to it, and all water wells within both valleys. They are the Klamath Basin coordinating council and the Technical Advisory Team, all self appointed with no vote by the public.
Some of the language is in Sections 19.2.3 and 19.4.5 and additional language in Sections 20.4, and 21.1.3 and Appendix B & C. There are over 270 pages of power grabbing language. Not enough ink to list all!
All this is accomplished by the Federal Government giving a "Charter" to the Tribes and Environmental groups(NGO). By the formation of 2 Councils, (Klamath Basin Coordinating Council (kbcc) and the Technical Advisory Team (tat)..).They will have full authority to say how when where YOUR water will be used.
Our Elected BOS will effectively have been replaced by these self-appointed councils.
Why is our BOS even considering signing these agreements? Why would the BOS agree to give away OUR rights?
This governance was acknowledged by Supervisor Kobseff at the board meeting of January 18, 2010. He said, governance is already being practiced because the county is being dictated to by the Envros as to when and were to hold meetings they are conducting that will have an effect on Siskiyou County.
The KBRA, if signed, gives the Tribes more water rights than exists today, with the exception for a few years in each century. The sections in the KBRA cited above give de facto cart blanche over everyone's water. All the NGO's have to say is they "BELIVE" there is not enough water for fish, and they can divert what ever they wish.
The KBRA does NOT offer protection from the Endangered Species Act (ESA). In fact the Tribes can invoke the ESA and stop any farmer from Irrigating or you using your well to have a drink of water from your sink in your house! The City of Yreka's water rights are in danger even though there has been some MINOR language changes in the KHSA that supposedly will protect that right. A review by more than one person finds no protective language. The KBRA takes away that right by invoking the ESA.
Under the agreement they can introduce other species to the Klamath system and then say they need even more water.
This is a train wreck folks that can be stopped.
It requires our elected BOS to utilize the existing State statues that were passed exclusively for Siskiyou County. It is in Water Code 89, Appendix "B."
Tied to the Klamath Basin Compact, approved and ratified by both Legislatures of Oregon and California, signed by Congress, and the President of the Untied States!
The County can take over the Dams (LEGALLY). Never mind the Problems associated with the ownership. The dams produce $168 million annually,(security and exchange commission filings). That's more than enough to handle the problems. Just think of the economic boost to our County. If anyone has further questions, please feel free to contact me.
