Klamath River — With the Environmental Protection Agency’s (EPA)
recent approval of the Klamath River Total Maximum Daily Loads (TMDLs),
several groups have shown cause to legally challenge their
implementation; however, one party recently reported to have
threatened suit has not yet made that commitment.
In an article posted to www.upi.com Wednesday, it is stated that
PacifiCorp, which owns dams along the Klamath, has threatened to
sue the EPA over the TMDLs. That is “not accurate,” according to
PacifiCorp spokesman Art Sasse, who stated Thursday that right
now the company is simply assessing its options “to best
protect” its customers.
The TMDLs, which set forth pollution limits and goals for
temperatures, identify the dams as a stressor on the river, with
PacifiCorp contending that some of the modeling used to develop
the TMDLs was flawed.
With the TMDLs for the California portion of the Klamath now
approved, the EPA northwestern region will be reviewing those
developed for Oregon’s portion this month, according to a recent
press release.
