Original Deed, showing water rights

Here is a copy from two of the many original deeds possessed by our homesteading war veterans. This sample actually is from a 1953 deed, except the last section is from a 1940 deed showing a signature by President Franklin D. Roosevelt. The name of the veteran and description of property is deleted to protect identity's of the veterans. The question remains, how can contracts from the 1940's and 1950's between our President and our War Veterans now be overruled by a 1973 Endangered Species Act?
